Terms & Conditions

Welcome to QualDrive Driving School (“QualDrive,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website at qualdrive.co.uk and our driving instruction services (together referred to as the “Services”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

2. Eligibility and Learning Rules

  • Age and Licence:
    You must be at least 17 years old (or 16 with an appropriate medical exemption) and hold a valid provisional driving licence for Great Britain or Northern Ireland.

  • Supervision and ‘L’ Plates:
    Lessons must be supervised by a Qualified Driving Instructor (ADI) or Potential Driving Instructor (PDI). Private supervisors must be over 21 with a valid full driving licence held for at least three years.

  • Motorway Driving:
    Permitted only in England, Scotland, or Wales when supervised by an ADI in a dual-control car.

  • Recommended Practice:
    GOV.UK advises completing at least 45 hours of professional tuition and 22 hours of private practice before taking your driving test.


3. Bookings, Payments, and Cancellations

  • Bookings:
    Lessons are subject to instructor availability and may be rescheduled due to illness, vehicle maintenance, or adverse weather conditions.

  • Payment Terms:
    Payments must be made directly to the instructor via credit/debit card, bank transfer, Adyen Pay (via TotalDrive), or cash (with prior instructor approval). Lesson payments are due 24 hours before the lesson start time. A receipt will be provided for all payments.

  • Cancellation Policy:
    Provide at least 48 hours’ notice to cancel or reschedule a lesson without charge. Failure to do so will result in the full lesson fee being charged.
    The Driving Instructor will not be responsible for any costs resulting from postponed lessons, including those due to weather or illness.


4. Your Obligations

  • Accurate Information:
    Provide truthful and up-to-date personal details.

  • Safety Standards:
    Ensure your eyesight meets DVSA requirements and wear appropriate clothing and footwear for driving.
    Do not attend lessons under the influence of alcohol, drugs, or any substances affecting your ability to drive.


5. Data Protection

  • Data We Collect:
    Name, contact details, and lesson history.

  • Storage:
    Data is securely stored within our Supabase database in the UK/EU, accessible only by authorized personnel.

  • Purpose:
    To manage bookings, schedules, payments, and communications.

  • Your Rights:
    Under UK GDPR, you may access, correct, or request deletion of your data by contacting contact@qualdrive.co.uk.


6. Cookies and Tracking

  • Essential Cookies:
    Necessary for the website’s functionality.

  • Optional Cookies:
    Used for analytics via Hotjar and loaded only with your consent.

7. Driving Tests

  • Booking Tests:
    Driving tests may be booked by you or your instructor. Lessons may be adjusted to accommodate test bookings.

  • Vehicle Use for Tests:
    The instructor reserves the right to withhold use of the training vehicle if your driving poses a safety risk or does not meet test standards.
    A two-hour fee will apply on test days for vehicle usage and travel.

  • Test Cancellations:
    The DVSA requires at least 10 full working days’ notice for car driving test cancellations or rescheduling. Failure to comply may result in test fees being forfeited.
    (Monday to Saturday count as working days; Sundays and public holidays do not.)


8. Liability and Disclaimers

  • Service Interruptions:
    We are not responsible for losses due to instructor unavailability, vehicle issues, or website downtime.

  • No Guarantee of Passing:
    Success depends on individual ability and practice. DVSA examiners are impartial and act as the regulatory awarding body.

  • Liability Cap:
    Our liability will not exceed fees paid in the 12 months preceding a claim.


9. Punctuality

  • Lesson Timing:
    Students should be punctual. Instructors will wait up to 15 minutes. If late, the lesson may be forfeited, and the fee will apply.

  • Instructor Delays:
    If an instructor is delayed, they will make up the lost time at the earliest convenience.


10. Intellectual Property

  • Ownership:
    All content on our website is owned or licensed by QualDrive Limited.

  • Usage:
    Content may be used only for personal, non-commercial purposes without prior written permission.


11. Changes to These Terms

We may update these Terms at any time. The “Last updated” date at the top will reflect changes. Your continued use after updates constitutes acceptance.


12. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Disputes will be settled in English courts.
