Terms and Conditions

Learning with QualDrive® – Simple Summary

We like to keep things clear and straightforward. This summary explains the key things you need to know when learning with QualDrive.

Please read the Full Terms & Conditions below, as these form part of your agreement when booking tuition with us.

Lessons & Payments

QualDrive operates primarily on a pay-as-you-go basis.

Lessons are normally managed and paid for through the TotalDrive learner app, although your Tuition Provider may agree to accept another payment method, such as bank transfer.

Lessons should normally be paid for at least 48 hours in advance, unless otherwise agreed. Where a lesson is arranged at shorter notice, payment may be required when the lesson is booked.

Before Your Lesson

Please be ready at the agreed time and location and ensure you are legally entitled and fit to drive.

You should wear suitable clothing and footwear and tell your instructor about any medical condition, medication, licence restriction or other change that could affect your ability or legal entitlement to drive safely.

If you’re not at the agreed location when your lesson begins, your instructor will normally wait for up to 15 minutes.

Cancellations

Please provide at least 48 hours’ notice if you need to cancel or rearrange a lesson.

Where less than 48 hours’ notice is provided, a cancellation charge may apply where your Tuition Provider is unable to reasonably refill the reserved lesson time.

Missed lessons or non-attendance may be charged at the full lesson price where the instructor’s reserved time has been lost.

Professional Tuition

Your tuition will be delivered by a DVSA-registered Approved Driving Instructor (ADI) or, where applicable, a DVSA-licensed trainee driving instructor (PDI).

Tuition will be structured around your individual development, with road safety, responsible decision-making and safe, independent driving at its core.

Your instructor will maintain appropriate lesson records and provide feedback about your progress and further training needs.

Safety, Respect & Professional Boundaries

QualDrive is committed to providing a safe, respectful and professional learning environment for every learner.

Instructors and learners are expected to treat each other with dignity and respect and maintain appropriate professional boundaries.

Safeguarding or professional-conduct concerns can be reported directly and confidentially to QualDrive at contact@qualdrive.co.uk.

Mobile Phones & Electronic Devices

Your instructor will remain attentive and appropriately focused on your tuition while you are driving.

Mobile phones and other hand-held devices will not be used, and calls will not be taken while instructing, including hands-free calls.

Electronic devices may be used for legitimate training purposes when the vehicle is safely parked and the engine switched off.

Driving Tests

You are responsible for booking, changing or cancelling your own practical driving test through the official DVSA service.

Before booking or changing a test, please check that your instructor and tuition vehicle are available.

Booking a driving test does not automatically reserve your instructor or their vehicle.

Test Readiness & Use of the Tuition Vehicle

Your instructor will regularly discuss your progress and readiness for the practical driving test.

If your instructor believes you are not at a safe and suitable standard, they may recommend postponing the test and may decline the use of their tuition vehicle.

Use of an instructor’s vehicle for a practical test is therefore subject to prior agreement and is not automatically guaranteed.

Cameras, Photography & Social Media

Tuition vehicles may use cameras for legitimate purposes such as safety, security, incident investigation, insurance or instructor development.

Photographs, videos, testimonials, pass photographs or other identifiable content will not be used for promotional or social-media purposes without your consent.

Consent for promotional use is separate from your agreement to receive driving tuition.

If Something Isn’t Right

Where appropriate, you can discuss a concern with your instructor.

If the matter is unresolved, involves your instructor, concerns safeguarding or professional conduct, or you would prefer not to raise it directly with them, please contact QualDrive at contact@qualdrive.co.uk or 01527 337 855.

Our Approach

We’re here to help you develop into a safe, confident and independent driver through structured, professional tuition.

By booking or receiving tuition through QualDrive, you agree to the Full Terms & Conditions below.

Full Terms & Conditions

Last updated: 25 September 2026

These Terms & Conditions apply to driving tuition and related services provided through QualDrive Limited (QualDrive®) and its network of self-employed Associate Instructors.

By booking, paying for or receiving tuition through QualDrive, you confirm that you have read and agree to these Terms & Conditions.

For the purposes of these Terms, “Tuition Provider” means either QualDrive Limited or the self-employed Associate Instructor providing your tuition, depending on who your tuition has been allocated to and who receives payment for that tuition.

These Terms should be read alongside our Privacy & Cookie Policy and any additional terms specifically agreed with you for a particular course or service.

If there is any difference between the Simple Summary above and these Full Terms & Conditions, these Full Terms & Conditions will apply.

1. Company Details

Legal Name: QualDrive Limited

Trading Name: QualDrive®

Registered Office: Greenlands Business Centre, Studley Road, Redditch, Worcestershire, B98 7HD

Company Number: 14973412 (England & Wales)

Email: contact@qualdrive.co.uk

Telephone: 01527 337 855

2. How QualDrive Works

QualDrive provides driving tuition through QualDrive Limited and a network of self-employed Associate Instructors operating under the QualDrive brand.

Depending on the instructor providing your tuition, your Tuition Provider may be QualDrive Limited or a self-employed Associate Instructor.

Your instructor is responsible for the professional delivery of your driving tuition and for meeting the legal and professional requirements applicable to their role.

QualDrive Limited provides the QualDrive brand, administrative systems, learner support and other services that support learners and instructors across the QualDrive network.

Learners are provided with access to the TotalDrive learner app, which is used to manage lessons, payments, progress and other aspects of their tuition.

Payments made through the learner app are allocated to the relevant Tuition Provider. Where tuition is provided directly by QualDrive Limited, payment is allocated to QualDrive Limited. Where tuition is provided by a self-employed Associate Instructor, payment is allocated to the account nominated by that instructor.

Where applicable, tuition may also be provided by a DVSA-licensed trainee driving instructor (PDI). A trainee instructor is not a fully qualified ADI but is authorised by the DVSA to provide paid driving instruction while completing the qualification process.

3. Eligibility to Learn

You must hold the appropriate valid driving licence or provisional driving licence, meet the legal eyesight requirements and be legally entitled to drive the vehicle used for your tuition.

You must tell your instructor about any medical condition, medication, licence restriction or change in circumstances that may affect your legal entitlement or ability to drive safely.

If your licence becomes lost, expired, revoked, suspended or otherwise invalid, you must tell your instructor before your next lesson.

Your instructor may ask to check your driving licence and entitlement to drive before tuition begins and subsequently where reasonably required.

Where a lesson cannot proceed because you are not legally entitled or fit to drive and the required cancellation notice has not been provided, the lesson may remain chargeable.

4. Bookings, Payments & Account Credit

QualDrive operates primarily on a pay-as-you-go basis.

Learners are normally provided with access to the TotalDrive learner app, where booked lessons, payments and available paid tuition hours can be managed.

When a lesson is booked, you must have sufficient paid tuition available on your account before the lesson takes place. If sufficient tuition is not already available, payment can be made through the learner app.

You may also choose to purchase tuition in advance. Any unused paid tuition will remain recorded against your learner account and can be used towards future lessons with your Tuition Provider, subject to these Terms.

Payments for tuition are normally made through TotalDrive. Where agreed with your Tuition Provider, alternative payment methods such as bank transfer may also be accepted.

Where payment is made outside the TotalDrive payment system, the Tuition Provider is responsible for maintaining an appropriate record of the payment and updating your learner account where applicable.

Where tuition is provided directly by QualDrive Limited, payment is allocated to QualDrive Limited. Where tuition is provided by a self-employed Associate Instructor, payment is allocated to the relevant Associate Instructor.

TotalDrive and its payment provider facilitate payments made through the app but do not provide the driving tuition.

The price of your tuition and any applicable mandatory payment or service fee will be shown before payment is completed.

Lessons should normally be paid for at least 48 hours in advance, unless otherwise agreed. Where a lesson is arranged at shorter notice, including where a cancellation slot becomes available, payment may be required at the time the lesson is booked.

Payments, available paid tuition and completed lessons will be appropriately recorded.

Clear upfront pricing, including unavoidable fees, is particularly important under current CMA price-transparency guidance. GOV.UK

5. Statutory Cancellation Rights

Where you enter into an agreement for tuition at a distance, you may have a statutory right to cancel the agreement within 14 days, in accordance with applicable consumer law.

Where you have agreed for driving tuition to begin during this 14-day period, you are requesting that your Tuition Provider begins providing tuition on the agreed lesson date.

If tuition has already begun and you subsequently exercise a statutory right to cancel, you may be required to pay for tuition already provided where permitted by law.

These statutory cancellation rights are separate from our lesson cancellation policy, which applies when an individual lesson has been booked and is subsequently cancelled or rearranged.

Nothing in these Terms affects your statutory consumer rights.

6. Block Bookings & Advance Purchases

QualDrive operates primarily on a pay-as-you-go basis, although learners may choose to purchase additional tuition hours in advance where this option is available.

Purchasing tuition in advance does not guarantee particular lesson dates or times, which remain subject to instructor availability.

Advance purchases are personal to the learner and are non-transferable, unless otherwise agreed.

Any unused prepaid tuition remains subject to the refund and cancellation provisions within these Terms.

Any promotional or course-specific package may have additional conditions, which will be made clear before purchase.

7. Cancellations & Lesson Changes

We understand that plans sometimes change. When a lesson is booked, your Tuition Provider reserves that time specifically for you and may be unable to offer it to another learner at short notice.

Please provide at least 48 hours’ notice if you need to cancel or rearrange a lesson.

Where sufficient notice is provided, there will normally be no cancellation charge and any payment or tuition credit allocated to the lesson can be used towards a future booking.

Where less than 48 hours’ notice is provided, a cancellation charge may apply where the Tuition Provider is unable to reasonably refill the reserved lesson time.

Any cancellation charge will not exceed the price of the cancelled lesson and will reflect the loss reasonably incurred as a result of the cancellation.

If the cancelled lesson time is successfully filled by another learner, you will not be charged for the same lost lesson time.

If you do not attend a booked lesson without providing notice, the lesson may be charged at the full lesson price, reflecting the instructor time reserved for you.

Cancellation or rearrangement requests should be made through the TotalDrive learner app or directly with your instructor using the agreed communication method.

Repeated late cancellations or non-attendance may result in your Tuition Provider being unable to continue reserving regular lesson times for you.

Where your Tuition Provider cancels a lesson, you will not be charged for tuition that has not been provided. Any payment or tuition credit allocated to that lesson will remain available for future tuition or will be refunded where appropriate.

Nothing in this section affects your statutory consumer rights.

This approach reflects current CMA guidance that cancellation charges should be proportionate to genuine loss and should account for reasonable steps to mitigate that loss. GOV.UK

8. Refunds

If you have paid for tuition in advance and decide not to continue, you may request a refund of any unused tuition balance, subject to these Terms.

Refunds will normally be initiated by the Tuition Provider who received the original payment.

Where payment was made through the TotalDrive learner app, the Tuition Provider may request the refund through TotalDrive and its applicable payment provider.

Where payment was made by bank transfer or another agreed payment method, the Tuition Provider will arrange the refund using an appropriate method.

Any tuition already provided, valid cancellation charges or other amounts properly due under these Terms may be deducted from the refundable balance.

Where reasonably possible, a refund will be returned using the same payment method originally used. Processing times may vary depending on the payment method, payment provider and bank or card provider.

QualDrive may assist learners and Associate Instructors with the administration or resolution of a refund where appropriate.

You will not lose unused prepaid tuition simply because a particular period of time has passed. If you have not taken lessons for an extended period, you may be asked to contact your Tuition Provider before further lessons are arranged.

Nothing in this section affects your statutory consumer rights.

The CMA specifically warns against automatic loss of upfront payments and disproportionate cancellation provisions. GOV.UK

9. Pricing

The price of your driving tuition will be made clear before payment or confirmation of the relevant service.

Tuition prices may vary depending on the Tuition Provider, type of tuition, course or service being provided.

Where payment is made through the TotalDrive learner app, the price payable and any applicable mandatory payment or service fee will be shown before payment is completed.

Your Tuition Provider may review or change their tuition prices from time to time. Where a price change affects your future tuition, you will be given reasonable notice before the new price applies.

Any tuition that has already been paid for will normally remain available at the value or number of tuition hours purchased, unless different terms were clearly agreed with you at the time of purchase.

Promotional prices, introductory offers or course packages may be subject to additional conditions. Any such conditions will be made clear before purchase.

Nothing in this section affects your statutory consumer rights.

10. Your Responsibilities

You must be legally entitled and fit to drive for every lesson and must meet any applicable driving licence and eyesight requirements.

You must tell your instructor about any medical condition, medication, licence restriction or change in circumstances that could affect your ability or legal entitlement to drive.

You must not attend a lesson while impaired by alcohol, illegal drugs, medication or any other substance or condition that could make driving unsafe or unlawful.

You should be ready at the agreed time and location and wear suitable clothing and footwear that allows you to operate the vehicle safely.

You must follow reasonable instructions given by your instructor where these relate to road safety, vehicle control or the safe conduct of the lesson.

Learners are expected to treat their instructor, the tuition vehicle and other people with respect. Abusive, threatening, discriminatory, aggressive or otherwise inappropriate behaviour will not be accepted.

As driving tuition takes place within a shared vehicle environment, learners are also expected to maintain a reasonable standard of personal hygiene.

If your instructor reasonably believes that you are not legally entitled, fit or safe to drive, or that your behaviour makes it unsafe or inappropriate for the lesson to continue, they may refuse to begin the lesson or bring it to an end.

Where a lesson cannot proceed or has to be ended because of circumstances within your reasonable control, the lesson may remain chargeable, subject to these Terms.

11. Professional Standards

Driving tuition will be delivered in a professional, responsible and learner-centred manner, with road safety and the learner’s individual development at its core.

Tuition will be structured appropriately for your experience, ability and stage of development, with the aim of developing the knowledge, skills, judgement and confidence required for safe and independent driving.

QualDrive instructors are expected to provide tuition in accordance with applicable legal requirements, DVSA standards and the National Standard for Driver and Rider Training.

Your instructor will provide appropriate feedback and keep you reasonably informed about your progress, areas for development and further training needs.

Appropriate records of your tuition, including lessons and training hours, will be maintained to support your development and provide an accurate record of tuition delivered.

Approved Driving Instructors (ADIs) and trainee driving instructors (PDIs) providing paid tuition must maintain the appropriate DVSA registration or licence and display the appropriate ADI badge or trainee instructor licence where required.

Your instructor will act with integrity, professionalism and respect and is expected to maintain appropriate professional standards throughout the instructor–learner relationship.

QualDrive does not guarantee that a learner will reach test standard within a particular number of lessons or that they will pass a driving test. Progress and the amount of training required will vary between individuals.

12. Safeguarding, Respect & Professional Boundaries

QualDrive is committed to providing a safe, respectful and professional learning environment for all learners, including learners under 18 and vulnerable adults.

Instructors and learners are expected to treat each other with dignity, courtesy and respect at all times. Abusive, threatening, intimidating, discriminatory, sexual or otherwise inappropriate behaviour or communication will not be accepted.

QualDrive instructors are expected to maintain appropriate professional boundaries throughout the instructor–learner relationship. Any physical contact must be appropriate, necessary and related to the safe or effective delivery of tuition.

Communication between instructors and learners should remain professional and appropriate to the tuition relationship, including communication through messaging, telephone, email or the learner app.

Where there is a safeguarding concern or an immediate risk to the safety or welfare of a learner or another person, QualDrive or the instructor may take appropriate action, including contacting a parent or guardian, relevant safeguarding organisation, emergency service or other appropriate authority where necessary or legally permitted.

If a learner’s behaviour makes it unsafe or inappropriate for tuition to continue, the instructor may stop the lesson or decline further tuition. Any payment or cancellation consequences will be considered in accordance with these Terms and the circumstances involved.

Safeguarding or professional-conduct concerns can be reported directly and confidentially to QualDrive at contact@qualdrive.co.uk. You do not need to raise a concern with your instructor first.

13. Mobile Phones & Electronic Devices

Your instructor will remain attentive and appropriately focused on your tuition while instructing.

Instructors must not use a hand-held mobile phone or other hand-held device while instructing and will not make or receive calls while a learner is driving, including hands-free calls.

Mobile phones should be appropriately stored or positioned so that they do not create an unnecessary distraction during tuition.

Electronic devices such as tablets or mobile phones may be used for legitimate training purposes, including lesson records, progress reviews, diagrams, route planning, reflective learning or other educational resources.

Where an electronic device needs to be actively operated or viewed for these purposes, the vehicle will first be parked safely and the engine switched off.

Nothing in this section prevents the use of equipment required for an emergency, safety or other lawful purpose where its use is necessary and appropriate.

14. Tuition Vehicles & Insurance

Vehicles used for paid driving tuition must be appropriately insured, roadworthy and legally compliant for the tuition being provided.

The Tuition Provider or instructor is responsible for ensuring that the tuition vehicle is appropriately maintained and that any legally required learner or instructor markings and DVSA identification are displayed where applicable.

You are expected to treat the tuition vehicle with reasonable care and follow reasonable instructions relating to its safe use.

You must tell your instructor promptly if you become aware of any damage, incident or issue involving the vehicle during your lesson.

Personal belongings brought into the tuition vehicle remain your responsibility. QualDrive and the Tuition Provider cannot accept responsibility for personal belongings that are lost or left in the vehicle, except where responsibility cannot lawfully be excluded.

You will not normally be responsible for ordinary wear and tear, mechanical failure or damage arising during normal supervised tuition.

Where damage is caused deliberately, recklessly or as a result of knowingly acting contrary to a clear safety instruction, the circumstances may be investigated and responsibility considered on an individual basis. Any amount sought from a learner must be reasonable, evidenced and legally recoverable.

If a tuition vehicle becomes unavailable because of a breakdown, accident or other unexpected issue, your instructor will aim to contact you as soon as reasonably possible and arrange an alternative lesson or suitable vehicle where available.

15. Lesson Structure & Punctuality

Lessons will normally begin and end at the agreed time and location shown in the learner app or otherwise agreed with your instructor.

Your booked lesson duration includes any agreed pick-up and drop-off time and forms part of your overall tuition.

You should be ready to begin your lesson at the agreed start time. If you are not present, your instructor will normally wait for up to 15 minutes and will make a reasonable attempt to contact you.

If you arrive late, the lesson will normally still finish at the original agreed time and the full booked lesson may remain chargeable.

If you have not arrived or made contact within 15 minutes, the lesson may be treated as a non-attendance and charged in accordance with the cancellation policy.

If you ask to finish a lesson early, the full booked lesson may remain chargeable because the instructor’s time has been reserved specifically for you.

If your instructor is delayed, they will make reasonable efforts to contact you. Where possible, the lost tuition time will be made up during the lesson or added to a future lesson.

Where an instructor is significantly delayed and the lesson cannot reasonably proceed, the lesson will be rearranged and you will not be charged for tuition that was not provided.

A lesson may begin or finish at a different location where this has been agreed with your instructor.

16. Progress & Lesson Records

Your instructor will maintain appropriate records of your driving tuition to support your learning, development and progression.

Lesson records may include the date and duration of tuition, areas covered, progress made, areas requiring further development and other relevant information about your training.

Your instructor will provide appropriate feedback and keep you reasonably informed about your progress, strengths, areas for development and further training needs.

Where digital systems such as the TotalDrive learner app are used, you may be able to view relevant lesson information, progress records and other aspects of your training through your learner account.

Learning to drive is individual, and the amount of tuition required will vary between learners. Any estimate of the number of lessons or hours you may require is therefore guidance only and is not a guarantee.

Your progress will be assessed according to your demonstrated ability and development rather than simply the number of lessons or hours you have completed.

QualDrive and your Tuition Provider cannot guarantee that you will reach practical-test standard within a particular number of lessons or that you will pass a driving test.

Lesson and progress records will be handled appropriately and in accordance with applicable data-protection requirements and our Privacy & Cookie Policy.

17. Booking & Managing Your Driving Test

You are responsible for booking, changing or cancelling your own practical driving test using the official DVSA service.

You should check that your instructor and tuition vehicle are available before booking or changing your test.

Booking a driving test does not automatically reserve your instructor or their tuition vehicle.

You are responsible for checking communications from the DVSA and ensuring that you know the correct date, time and location of your test.

Your instructor may provide general guidance about test availability and preparation but cannot take responsibility for managing your practical car driving-test booking.

18. Test Readiness & Use of the Tuition Vehicle

Your instructor will discuss your progress and practical-test readiness with you throughout your tuition.

Test readiness will be assessed according to your demonstrated driving ability, safety, consistency, judgement and ability to drive independently, rather than simply the date of your test or number of lessons completed.

Where your instructor reasonably believes that you have not yet reached a safe and suitable standard for the practical driving test, they may recommend that you postpone your test and undertake further training.

Your instructor may decline the use of their tuition vehicle for a practical driving test where they reasonably believe that presenting for the test would be unsafe, unlawful or professionally inappropriate.

Use of an instructor’s tuition vehicle for a practical driving test is therefore subject to prior agreement and is not automatically guaranteed.

An instructor’s assessment of your test readiness is a professional judgement based on your driving at that time. It does not guarantee the outcome of a DVSA practical driving test.

19. Practical Driving Test Day

A standard 2-hour booking will normally apply when an instructor and tuition vehicle are required for a practical driving test.

This normally allows appropriate time before the test, use of the tuition vehicle during the test and reasonable travel associated with the appointment.

Where additional travel time or other circumstances mean that a 2-hour booking is not sufficient, a longer booking may be required. Any additional time and cost will be explained and agreed beforehand.

You are responsible for bringing the correct driving licence and any other documentation required by the DVSA and for meeting the DVSA’s requirements for taking the test.

Where a test cannot proceed because you have not brought the required documentation or have not met a DVSA requirement, the instructor’s reserved time may remain chargeable.

If you would like your instructor to accompany you during your practical driving test or listen to the examiner’s debrief, this should be discussed and agreed with your instructor.

20. DVSA Test Cancellations & Changes

The DVSA may occasionally cancel, delay, relocate or otherwise change a practical driving test. These circumstances are outside the reasonable control of QualDrive and your Tuition Provider.

Where this happens, your instructor will make reasonable efforts to help you rearrange any associated tuition where possible.

Where instructor time and a tuition vehicle have already been reserved and the DVSA cancels or changes the test at short notice, any charge relating to the instructor’s reserved time will be considered reasonably and in accordance with these Terms.

You may be entitled to claim certain expenses directly from the DVSA in some circumstances. Any eligibility for reimbursement will be determined by the DVSA’s applicable rules at the time.

21. Instructor Changes & Unexpected Events

Illness, severe weather, vehicle breakdowns, accidents, emergencies or other circumstances outside reasonable control may occasionally affect your driving lesson.

Where possible, your instructor or QualDrive will contact you as soon as reasonably practicable and arrange an alternative lesson.

Where your instructor becomes unavailable for a longer period, QualDrive may offer tuition with another suitable instructor, subject to availability. You are not required to accept a replacement instructor.

Where prepaid tuition cannot be provided by your Tuition Provider and a suitable alternative cannot be agreed, any unused amount properly due to you will be dealt with in accordance with the refund provisions within these Terms.

You will not be charged for tuition that your Tuition Provider cancels and does not provide.

22. Emergencies & Incidents

Your instructor will take reasonable steps to maintain a safe learning environment and respond appropriately to emergencies or incidents that occur during tuition.

If an accident, medical emergency, breakdown or other serious incident occurs, the lesson may be stopped or altered where necessary to protect the safety of the learner, instructor or other road users.

Emergency services, breakdown assistance, insurers, QualDrive or another appropriate organisation may be contacted where reasonably necessary.

Any accident or incident involving the tuition vehicle may be appropriately recorded and reported for safety, insurance, legal or regulatory purposes.

23. Cameras & Recording

Tuition vehicles may use in-car or external cameras for legitimate purposes such as safety, security, incident investigation, insurance or instructor development.

Where cameras are in use, learners will be informed appropriately.

Recordings containing personal information will be handled in accordance with applicable data-protection requirements and our Privacy & Cookie Policy.

Recordings identifying a learner will not be distributed, circulated or published for promotional or other unrelated purposes without appropriate consent, unless disclosure is otherwise permitted or required by law.

Different rules may apply to recording during a practical driving test, and any applicable DVSA requirements must be followed.

24. Photography, Testimonials & Social Media

QualDrive or your instructor may invite you to provide a photograph, testimonial, review or other content, for example following a successful driving test.

Participation is entirely voluntary and is not a condition of receiving driving tuition.

Personal information, photographs, videos or other content that identifies you will not be used for marketing, promotional or social-media purposes without your explicit consent.

Where consent is provided, an appropriate record of that consent will be maintained.

Where additional consent is required because of the learner’s age or circumstances, this will be obtained before identifiable promotional content is used.

Consent for promotional activity is separate from your agreement to receive driving tuition.

25. Communication

Your instructor and QualDrive will aim to respond to communications within a reasonable period.

Responses may not always be immediate, particularly while instructors are teaching, driving, outside their normal working hours or otherwise unavailable.

Communications between learners and instructors should remain appropriate, respectful and relevant to the professional instructor–learner relationship.

The TotalDrive learner app may be used for lesson information, messages and other communications relating to your tuition.

Important changes to a booked lesson should be communicated through the agreed method wherever reasonably possible.

26. Complaints & Concerns

We want learners to feel comfortable raising concerns about their tuition or experience with QualDrive.

Where appropriate, you can discuss a concern directly with your instructor in the first instance.

If the matter remains unresolved, concerns your instructor, involves safeguarding or professional conduct, or you would prefer not to raise it directly with them, please contact QualDrive at contact@qualdrive.co.uk or 01527 337 855.

Complaints will be appropriately recorded and we will aim to deal with them fairly, promptly and professionally.

Where your tuition is provided by a self-employed Associate Instructor, QualDrive may assist with communication and resolution where appropriate. This does not alter the Associate Instructor’s responsibility for the professional services they provide.

You may also report concerns about the service or conduct of a Driving Instructor directly to the Driver and Vehicle Standards Agency (DVSA).

27. Data Protection & Privacy

QualDrive and its instructors will handle personal information in accordance with applicable UK data-protection law.

Personal information may be processed where appropriate to administer your tuition, manage bookings and payments, maintain lesson and progress records, communicate with you, provide customer support, deal with complaints and safeguarding concerns, and meet applicable legal or regulatory obligations.

Where TotalDrive or another service provider is used to support the delivery or administration of tuition, personal information may be processed through those systems where necessary and appropriate.

Personal information will be appropriately protected and retained only for as long as reasonably necessary in accordance with applicable legal, regulatory and operational requirements.

Further information about how QualDrive handles personal information and your rights is available in our Privacy & Cookie Policy.

28. Intellectual Property

The QualDrive name, branding, logos, training resources, written materials and other intellectual property belonging to QualDrive may not be copied, reproduced, distributed or used without appropriate permission.

Training materials provided to learners are for their personal learning and development unless otherwise stated.

Nothing in these Terms prevents you from retaining your own legitimate records relating to your tuition.

29. Ending Tuition

You may stop taking driving lessons at any time, subject to the cancellation, payment and refund provisions within these Terms.

QualDrive or your Tuition Provider may also decline or discontinue tuition where there is a legitimate reason to do so.

This may include persistent non-payment, repeated non-attendance or late cancellations, unsafe behaviour, abuse or inappropriate conduct, loss of legal entitlement to drive, a serious breakdown in the professional instructor–learner relationship, or other circumstances that make continued tuition unsafe or impractical.

Where reasonably appropriate, the reason for discontinuing tuition will be explained to you.

Where tuition ends, any unused prepaid tuition will be dealt with in accordance with the refund provisions within these Terms and your statutory rights.

Ending tuition does not affect any rights or obligations that arose before the tuition relationship ended.

30. Liability

QualDrive and your Tuition Provider will exercise reasonable care and skill in providing the services for which they are responsible.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

Neither QualDrive nor your Tuition Provider will be responsible for a failure or delay caused solely by circumstances outside their reasonable control where reasonable steps have been taken to minimise the effect of the disruption.

Where tuition is provided by a self-employed Associate Instructor, that instructor remains responsible for the professional tuition and services they personally provide. QualDrive Limited remains responsible for the services and obligations undertaken by QualDrive Limited.

Nothing in these Terms affects your statutory rights as a consumer.

31. Changes to These Terms

These Terms may be updated from time to time to reflect changes to our services, systems, business practices, legislation, regulation or DVSA requirements.

The current version will be published on the QualDrive website and will show the date on which it was last updated.

Where TotalDrive requires you to acknowledge updated Driving School Terms & Conditions, you may be asked to review and accept the revised Terms when you next access your learner account.

Changes will not be used to remove rights that you have already acquired under applicable consumer law or to retrospectively alter completed services.

Where a material change affects existing prepaid tuition or a service already agreed with you, we will take reasonable steps to bring the change to your attention where appropriate.

32. Entire Agreement

These Terms, together with any additional terms expressly agreed with you for a particular course, package or service, set out the terms applying to the relevant tuition or service.

Where additional terms apply, they will be made available or explained to you before the relevant service is purchased where required.

Nothing in this section excludes information or rights that form part of your agreement under applicable consumer law.

33. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer, nothing in these Terms removes any mandatory legal rights you may have regarding the law applicable to your agreement or where legal proceedings may be brought.
